5This is my current Lease I use for Rental Property. <
:Portions of it have been selected from a variety of other >
<leases and agreements. I will not gurantee the legality of 3
it, but it works well for me. Use it, change it.
RESIDENCE LEASE AGREEMENT

Paying Rent:

2-Party checks. M
Any check written by persons who have not signed this lease agreement. M
Personal checks written on banks located outside the Denver-Metro area, K
Iunless cleared through the owner. E)
Post-dated checks. F)
Any payroll "
checks signed-over to the owner.J
H 2. If any of the tenant's checks "Bounce", thereafter, and for the M
Kduration of the tenancy, the owner will no longer allow tenant to pay rent P
Nwith a personal check. Thereafter the tenant must pay rent with either cash, "
money order, or certified funds.O
M 3. The tenant is liable for any fines assessed against the owner by the M
Kbank or mortgage company if any of the tenant's checks "Bounce" causing an L
overdraft or late fee to be paid by the owner because of the "Bad Check". O
M 4. Owner accepts absolutely no responsibility for any rents (especially K
Icash) left unattended and without the owner's knowledge at his doorstep,
mailbox, etc.N
L 5. It is the explicit responsibility of the tenant to deliver the rent L
Jto the owner, not the duty of the owner to pick up rents unless so agreed
upon.I
G 6. All parties "Tenant" under this agreement shall be jointly and O
Mseverally liable for all lease payments and for the performance of all other J
Hobligations of tenant under this agreement; and each parties' community 4
property and separate property shall be so liable.L
J 7. All fines, penalties, and charges accrued during the tenancy that O
Mhave not been previously paid will be settled before the tenant receives the %
balance of the performance deposit.

Responsibilities:
O 1. Tenant must pay rent in accordance with the guidelines written above. K
IThe tenant acknowledges payment of the rent as
FIRST PRIORITY
over all
other consumer debts.M
K 2. Tenant is responsible for paying his/her own water, utilities, and 0
trash removal costs unless otherwise arranged.K
I 3. Tenant may not purchase any item or service for the property and H
Fexpect the owner to reimburse the tenant without first discussing and J
Hreceiving a WRITTEN approval from the owner. No other person may grant
approval.M
K 4. Tenants must agree to cut grass when necessary and to water grass, M
Kshrubs, and trees adequately and regularly to coincide with the respective J
Hwatering days. Tenants be advised that the owner does not furnish lawn %
mower, hose, or sprinkling devices.O
M 5. Tenants will NOT PRUNE any shrub, bush, tree, or any flowering plant <
on the property without the prior permission of the owner.I
G 6. Tenant agrees NOT to keep any pets on the property, not at the H
Foutset, nor at any later time during the tenancy, unless covered by a K
Iseparate written agreement. Tenant may not temporarily keep any pet for H
another person (relative, friend, or neighbor) for any length of time.H
F 7. Tenants agrees to pay, at their expenses, for all repairs and N
Lmaintenance (stoppage of any drain or toilet etc.) caused by the negligence
of tenant or his invitees.P
N 8. Tenant agrees NOT to make any sort of alteration or change whatsoever O
Mto the property without WRITTEN permission from the owner. This pertains to M
Kthe exterior of the home, garage, interior walls, floors, doors, ceilings, O
Mcarpeting, mirrors, light fixtures, appliances, and any other item in and on
the property.M
K 9. Tenant agrees NOT to change any locks on entrance doors or add any
locks to these doors.G
E 10. Tenant agrees to keep all appliances, window coverings, and O
Mcarpeting clean and in good repair. Any appliance that breaks down shall be P
Nrepaired by the owner, UNLESS, Carelessness on the part of the tenant created O
Mthe breakdown. It will then be repaired and the cost will be charged to the B
tenant. You are cautioned to be careful with smoking materials.

Responsibilities Continued:
N 1. Any window breakage (regardless of the fault) shall be repaired. The N
Lowner shall pay 25% of the cost of labor and materials and the tenant shall E
Cpay the balance. In the event of rain, all windows must be closed M
Ksufficiently to prevent any rain from entering. The resident will be held 0
responsible for all drapery and carpet stains.O
M 2. Periodically, the owner will want to make a visual inspection of the N
Linterior of the property. Tenant agrees to allow the owner to look through G
the home upon request, at a reasonable hour, and with tenant present.J
H 3. Tenants agree not to Sub-Lease or Sub-Rent this property to any G
Epersons nor allow any unrelated persons to occupy this dwelling on a
"Live-in" basis.N
L 4. Tenants willingly agree to pay any and all legal fees, court costs, N
Land associated costs in evicting subject tenant or collecting rent due from
the tenant.

If the tenant moves away before the Lease expires, the owner will NOT N
Lrefund any of the performance deposit (unless covered by a separate written H
Fagreement). If the tenant is evicted or leaves during the process of K
Ieviction (which begins with the Demand-for-Rent or Eviction Notice being O
Mposted upon the front door) the performance deposit will be retained as part K
Iof liquidated damages and tenant will still be held liable for any other N
Ldamages, fines, or charges accrued during the tenancy that were not settled N
Lplus any awards made by the County Court against the tenant and in favor of
the owner.G
Should the tenant "Hold Over" his/her tenancy beyond the stated P
Ntermination date (either deliberately of irresponsibly) without entering into M
Ka further agreement with the owner, this Out-Going tenant shall be charged G
E$40.00 per DAY as a fine for denying full-use of the property to the M
KIn-Coming tenant. NOTE: Holding-Over the the tenancy is also construed to N
Lmean : Storing furniture inside the property to return and secure at a more N
Lconvenient time or refusing to return ALL of the house keys on the last day N
Lof the tenancy. Both of these acts will deny the In-Coming tenant security N
Land full-use of his rights as a tenant. If the house keys are not returned M
Kat all by the Out-Going tenant, the owner will change the locks and charge 0
the Out-Going tenant $19.50 per entrance door.

Return of Performance Deposit ( $ ) Held by Owner.
K The performance deposit is a sum of money held by the owner to insure G
Ethat the perspective tenant performs his/her duties and executes the O
Mresponsibilities described within this Lease agreement. It is also, but not H
Fnecessarily limited to, a deposit retained to assure the owner of the I
Gproperty that the tenant will surrender the property cleaned, in "good ,
condition", and ready for the next tenant.H
F Return of the performance deposit will be offered only after the G
Efollowing items have been satisfactorily completed : 1. The tenant's P
Ntermination statement has been received by the owner 20 days prior to the end P
Nof the Lease. 2. The tenant has removed all of his/her belongings (including F
Dtrash) from the property (Owner will charge $45.00 per pick-up load G
E-part
full- to remove any unwanted furniture or accumulated trash N
Labandoned at the property. 3. House and grounds (lawns mowed) are suitably L
Jcleaned for In-Coming tenant (Cleanliness to be judged by the owner -
any O
Mcleaning to be done will be completed and charged to the Out-Going tenant at L
J$8.50 per hour. 4. All keys to the dwelling returned to the owner. 5. A O
Mpaid receipt from the water department is surrendered to the owner showing a L
J"paid-up" water bill by the Out-Going tenant. 6. A walk-through has been O
Mmade by the owner to establish any discrepancies or to approve the out-going L
Jtenants restoration of the property. 7. The performance deposit less any G
Efines, unpaid costs, charges (accumulated during the tenancy but not L
Jsatisfied) will all be subtracted from the deposit and the balance of the L
Jmoney will be sent to the Out-Going tenant's new residence. Colorado law 6
allows 30 days for the landlords to return deposits.

CONDITION OF THE DWELLING AND ITEMS IN IT:
L Before you move in, we will inspect and inventory the Dwelling and the M
Kitems in it. We will prepare an INSPECTION REPORT, which you should check M
Kcarefully. All interested parties will sign the report. When signed this M
Kreport will be our agreement about: (1) What the condition of the Dwelling L
Jwas, and (2) what items were in the Dwelling and what their condition was
when you moved in. G
E When you move out the Dwelling must be left as described in the J
HInspection Report, except for NORMAL wear and tear. WE WILL CHARGE YOU M
KADDITIONAL RENT FOR THE NUMBER OF DAYS IT TAKES US TO CLEAN AND FIX UP THE N
LDWELLING IF YOU DO NOT DO YOUR PART. REMEMBER: It is your duty to have the P
NDwelling clean and in proper condition ON THE DAY OF THE MOVE OUT, NOT ON ANY
LATER DAY.
EK. False information in either the Rental Application or the Lease I
Agreement is just cause to void the Lease and cause immediate eviction.
